February 10th - Audio Teleconference

ASSE-LA will be hosting a one-hour audio teleconference dealing with Cal/OSHA regulatory changes in fall protection, and American National Standards Institute (ANSI) standard changes (including the newly approved ANSI A10.32 - 2004 "Fall Protection Systems for Construction and Demolition Operations"). Participants will receive an article regarding "construction fall protection" and a Powerpoint presentation "guide" for the teleconference. Details will be sent to members this month. "Sue Your Boss" Law

Our March dinner meeting will feature State Senator Joe Dunn of Garden Grove who will discuss his experiences with SB796 also know as "Sue Your Boss" Law.California's "Sue Your Boss" law allowed employees and former employees to sue for any violation of the California Labor Code, and to pocket civil penalties and collect attorney's fees. The most onerous provisions of the "Sue Your Boss" legislation, SB 796 (Dunn), were repealed as part of the state budget package in 2004, with the passage of SB 1809 (Dunn). The Business Council joined the California Chamber and many other business groups across the state in pushing for this action.

We’re off to a fast start with the "full house" attendance at January’s meeting. Tom Jordan from Gale / Jordan Associates in Redondo Beach presented an asbestos & lead regulatory update along with a discussion of general construction information.

Discussion was lively !!!!!

PROP. 65 & TITLE 8 — PROPOSED CHANGES

Proposition 65 - OFFICE OF ENVIRONMENTAL HEALTH HAZARD ASSESSMENT

Chemicals under Consideration Request for Possible Listing Via the Authoritative Bodies Mechanisms

As the lead agency for the implementation of Proposition 65, the Office of Environmental Health Hazard Assessment (OEHHA) within the California Environmental Protection Agency is investigating the possible listing of 2 bromopropane as a chemical known to cause reproductive toxicity (female and male endpoints), based upon information in the reference cited. Documentation summarizing the rationale for considering the evaluation of this chemical for possible administrative listing is available from OEHHA’s Proposition 65 Implementation Office via the Internet at the following address: http://www.oehha.ca.gov/prop65.html.

TITLE 8: DIVISION OF LABOR STANDARDS ENFORCEMENT (DLSE)

Section 13700, Meal and Rest Periods, in Title 8 of the California Code of Regulations

DLSE proposes to adopt section 13700 to clarify that the one hour of pay an employer must pay an employee for each workday in which a meal or rest period is not provided in accordance with the applicable Industrial Welfare Commission Order is considered a penalty as well as to clarify the time parameters and criteria under which meal periods can be provided to employees. Existing statute specifies that employers cannot allow employees to work more than five hours without providing a 30-minute meal period. Existing law is unclear as to the specific time parameters under which meal periods can be provided to employees. Furthermore, the law does not provide criteria to determine if an employer has met the statutory requirement of providing a meal period. Additionally, existing law does not define the term ‘‘work period.’’ Existing statute provides that an employer who fails to provide an employee a meal period or rest period is required to pay the employee one additional hour of pay at the employee’s regular rate of pay for each work day that the meal or rest period is not provided. Existing law has been the subject of conflicting interpretations as to whether the one hour of pay is to be considered a wage or penalty. The proposed regulation would: (1) establish criteria to determine if an employer has met the requirement of providing a meal period; (2) clarify that the initial meal period in a workday may commence by the end of the sixth hour of the workday; (3) provide a definition of the term ‘‘work period’’; and (4) clarify that the one hour of pay an employer must pay an employee for each workday in which a meal or rest period is not provided in accordance with the applicable Industrial Welfare Commission Order is considered a penalty.

As ASSE-LA grows, we have gone from 311 to 323 members in the last 6 months, so does our pool of talented individuals. The next ASSE-LA meeting will demonstrate the talents of our Programs Vice President Louis Therrien. In what will be a one of a kind ASSE-LA meeting, we will have our first teleconference meeting. The speakers will be a CalOSHA representative and an ANSI representative to talk on new fall protection regulations. It's so easy, you sign up for the meeting and from the convenience of your office, dial a special phone number and participate in an ASSELA meeting on the latest changes in "Fall Protection". 10 Tips for Working Effectively with Your Latino Workforce

  1. Treat your Spanish-speaking employees like you would want to be treated if you were a new immigrant in a foreign country.
  2. Put forth some effort to understand their culture and traditions.
  3. Teach your American workers about Latino culture and your Latino workers about American culture.
  4. Even though you may not know their language, make simple efforts to greet your Latino employees, use their first names, smile and a gently pat them on the back. Doing these little things may go a very long way in closing the communication and cultural gap.
  5. Train your Spanish-speaking workforce in their native language.
  6. Hire an effective Spanish-speaking trainer. Avoid using bilingual employees as interpreters.
  7. Provide Spanish-language training materials that are written at an appropriate comprehension level for your workforce.
  8. Use plenty of pictures, diagrams, and charts, and avoid technical words in your training presentations and printed materials.
  9. When implementing an incentive plan, try to incorporate group rewards rather than recognizing individuals.
  10. Be politically correct. Remember that many different cultures make up the Latino population. Referring to your workforce as "Mexicans" may be offensive to your Guatemalans or Ecuadorians. Use "Spanish-speaking" or "Latino" instead.
  11. Remember, any effort you make to welcome your Latino workforce will be appreciated. By incorporating these tips, you will be rewarded with a loyal, hard-working, culturally diverse workforce.
